Contaminated Land

In July 2000, a new legal framework was enacted in Scotland to tackle the legacy of contaminated land left as a consequence of our industrial development.
The new framework requires Local Authorities to detail a strategic framework for handling issues relating to contaminated land in their areas. This framework provides some insight into the proposed timetable for inspection of their area and the standards they intend to enforce where required.
The Team will be involved in assessment and inspection of all land likely to have been contaminated over the years. This will involve contact with other Council services, landowners, householders and various bodies. The long term aim of the regime is to ensure that all land within Clackmannanshire is suitable for use.
The Council will actively seek voluntary remediation of contaminated land sites, wherever possible. Where such options are not available, powers do exist to force the appropriate persons concerned to remediate the contamination to which they are responsible. It should also be noted that on many occasions, land may be found to contain contamination but it does not fall within the definition of contaminated land as defined.
The protocols intended to be followed by the team are contained in the contaminated land strategy document available to download from this site by following the link in the Publications and documents section below.
