Heirarchy Of Developments
A key aspect of the planning reform agenda is the introduction of three categories of development. These are:
- National Developments
- Major Developments
- Local Developments
National Developments are identified in the National Planning Framework for Scotland (NPF 2) prepared by the Scottish Government. There are currently no national developments proposed for the Clackmannanshire area.
There are nine classes of major developments, and these are as follows:
- All development under Schedule 1 of the EIA (Scotland) Regulations 1999.
- Housing proposals of 50 dwellings or more, or housing sites exceeding 2 hectares (ha).
- Business and general industrial, storage and distribution with a gross floorspace of 10,000 m2 or a site exceeding 2 ha.
- Electricity Generation where capacity is or exceeds 20 MW.
- Waste Management Facilities where capacity is or exceeds 250,000 tonnes per annum, or for sludge treatment facilities where capacity of or exceeds 50 tonnes (wet weight) daily.
- Transport and Infrastructure where the road, railway, tramway, waterway, aquaduct or pipeline exceeding 8 km in length.
- Fish Farming where the surface area of water covered exceeds 2ha.
- Mineral Extraction where the site area is or exceeds 2 ha.
- Other Development not falling wholly within one of the above classes where the gross floor space is or exceeds 5,000 m2 or a site area exceeding 2 ha.
All other developments that require planning permission are categorised as local developments. This is likely to comprise a significant majority of planning applications submitted to the Council.
The most significant implications of the hierarchy of developments are the need for pre-application consultation on major applications, decision making arrangements either by appointed officers under the scheme of delegation or by members of the Council, the scope to review decisions by the Council's Local Review Body (LRB) or the submission of planning appeals, and the need to notify the Council and display a site notice before, during and after the implementation of the development.
