Clackmannanshire District Court
General Information
Provided that no warrant or extract warrants have been issued by the court in respect of the fine, payment can be made as follows:
- by cash, cheque or postal order direct at the
- cash collection point at Clackmannanshire Council Offices, Greenfield, Alloa, or
- District Court itself, Bank Street, Alloa;
- by telephone on 01259 452044 using your Switch/Debit/Credit/Visa Electron.
Where the fine relates to a speeding offence which requires the licence to be endorsed, payment cannot be accepted by telephone. You are required to produce both parts of the licence (new paper/photo card licences), together with cash, cheque or a postal order for the amount payable to the cash collection point at Greenfield.
Fixed penalty fines will only be accepted if payment is tendered within the 28-day period stipulated. Where a driving licence is required, payment cannot be accepted unless the licence is produced.
History of the District Court
The District Courts (Scotland) Act 1975 introduced the present system whereby from 16 May that year, new District Courts were set up in each of the 56 new District and Islands areas (except one island area where there would have been insufficient business for the court).Clackmannanshire District Court is one such Court.
Central Advisory Committee
A widely representative committee appointed by the Scottish Minister to advise him/her about the work of Justices of the Peace. The chairperson has the title Lord Justice Clerk.
Local Advisory Committee
A committee appointed in each commission area by the Scottish Minister to review the availability of Justices of the Peace and to make recommendations for additional appointments. The chairperson has the title Lord Lieutenant.
Role of the Clerk of Peace
An official of the Council appointed to carry out duties such as: assisting Justices in the performance of their functions, arranging meetings of Justices, keeping records and notifying the Scottish Minister of changes of address, deaths and other circumstances affecting records.
Role of the Clerk of Court
An official of the District or Islands Council (solicitor) who attends court and is responsible for giving advice to Justices of the Peace on points and law/procedures to be followed.
Appointment of Justices of the Peace
Anyone may put forward as a nominee for appointment by writing to the Local Advisory Committee. This Committee will thereafter consider the suitability of the candidate and will, in some cases, recommend an appointment to the Scottish Minister. Any person over the age of 64 would not normally be appointed.
Justices of the Peace require to reside no further than 15 miles outside the boundary of the area he/she holds the appointment in.
