Work of Justices of the Peace

The work of Justices of the Peace consists of (a) "signing papers" presented by members of the public and (b) sitting in the District Court.

Signing duties of a Justice consist mainly of taking declarations, authenticating signatures or giving certificates. They include taking of affidavits, ie: statements on oath or equivalent solemn affirmations.

Sitting Justices would normally deal with offenders brought before the Court in relation to common law offences such as Assault/Breach of the Peace. Statutory offences such as breaches of local Acts and Bye-laws, the Licensing (Scotland) Acts, the Road Traffic Acts, the Criminal Justice (Scotland) Act 1982 and the Transport Act 1982 are also dealt with.

The District Court can only deal with offences which carry a maximum penalty of level four (a fine of up to £2500/maximum term of imprisonment 60 days).

The District Court can only deal with summary complaints whereas, the Sheriff Court may deal with both solemn and summary complaints.
