Licence - Approved Marriage Premises

The Council would prefer applicants to apply, register or give notification online if at all possible. It will remain possible, however, to arrange for the Licensing Administrator to send you the application/registration form you require or for you to collect forms at the Council's main office at Kilncraigs. You can also download a PDF of the form on the Licensing Application Forms page and lodge the completed form with the appropriate fee and necessary supporting documents with the District Registrar by post or by calling at The Registry Office, Marshill House.

Licence summary


If you wish to offer civil marriages at your premises or vessel, your premises or vessel must be registered with your local authority.

Applications for registration must include specified information and be accompanied by a fee.

You must comply with conditions attached to an approval.

Eligibility Criteria


The application must be in writing (including by electronic means) and include the name and address of the applicant and a plan/description of the place or, for vessels, the intended position of the vessel in sufficient detail to allow a local authority inspection.

A fee of £300.00 will be payable.

Regulation Summary


The Marriage (Approval of Places) (Scotland) Regulations 2002 (S.S.I. 2002 No. 260) were approved by the Scottish Parliament on 28 May 2002 and came into force on 10 June 2002. The regulations allow civil marriages to be solemnised at any approved place, including any premises, fixed buildings, temporary structures, land (including any land covered with water insofar as within the jurisdiction of the registration district) and any vessels (either within the seaward boundary of the registration district or in Scottish waters), without compromising the fundamental principles of Scottish marriage law and the solemnity and dignity of civil marriage.

Application Evaluation Process


Your premises or vessel maybe inspected.

Public notice will be given and any objections by the public must be considered.

Approval will not be granted if:
The local authority must have regard to the guidance issued by the Registrar General of Scotland.

The applicant must be a fit and proper person.

Conditions may be attached to approvals.

Will Tacit Consent Apply?


Yes. This means that you will be able to act as though your application is granted if you have not heard from the local authority by the end of the target completion period which is 2 calendar months from receipt of all documentation related to the application.

Failed Application Redress


Please contact the District Registrar in the first instance.

You have the right of appeal to the sheriff against a refusal of the application.

If you have had an application refused the local authority will not consider another application in respect of the same place or vessel within one year unless there has been a material change of circumstance.

Licence Holder Redress


Please contact the District Registrar in the first instance.

You have the right of appeal to the sheriff against conditions attached to the granting of approval.

If your approval is revoked, suspended or varied you will be given the opportunity to be heard by the local authority. You also have the right of appeal to the sheriff.

Consumer Complaint


We would always advise that in the event of a complaint the first contact is made with the trader by you - preferably in the form a letter (with proof of delivery). If that has not worked, if you are located in the UK, Consumer Direct will give you advice. From outside the UK contact the UK European Consumer Centre.

Other Redress


If you object to an application for approval you may give notice to the District Registrar within 21 days from the date on which public notice was given.
