Licensing Board Race Equality Scheme

Clackmannanshire Licensing Board was established under the Licensing (Scotland) Act 1976. It is made up of a number of the elected members of Clackmannanshire Council and has the responsibility for administering the liquor licensing system within Clackmannanshire

Institutional racism was defined in the Macpherson report which was complied after the inquiry into the death of Stephen Lawrence as “The collective failure of an organisation to provide an appropriate and professional service to people because of their colour, culture or ethnic origin. It can be seen or detected in processes, attitudes and behaviour which amount to discrimination through unwitting prejudice, ignorance, thoughtlessness and racist stereotyping which disadvantage minority ethnic people.”

Following the MacPherson report the Race Relations Amendment Act was introduced to make sure that public organisations such as the police, local authorities and licensing boards take a more positive approach towards racial equality. The Act introduces a number of key changes to the Race Relations Act strengthening already existing protections against unlawful discrimination on the grounds of race with a particular emphasis on outlawing discriminatory practices by public bodies and by defining a role for public bodies in the promotion of racial equality.

In terms of the Race Relations (Amendment) Act 2000 and the Race Relations Act 1976 (Statutory Duties (Scotland) Order 2002, the Board has been placed under a general duty to:-

  • Eliminate unlawful racial discrimination
  • Promote equality of opportunity
  • Promote good race relations between people of different racial groups
