Registering a Stillbirth
Dealing with a stillbirth is a distressing and traumatic experience. Registering the event is however something that cannot be avoided. Our aim in Clackmannanshire is to make the registration experience as simple as possible.
The following information may help prepare those facing the need to register a stillbirth at the Clackmannanshire Registration office.
The legal definition of a stillborn child is: A child that has been born after the twenty-fourth week of pregnancy and did not breathe or show any other sign of life.
Who can Register a Stillbirth in Scotland?
Normally, registration would be completed by one, or both, of the baby's parents.
If the baby's parents are married to each other at the time of registration, then either parent may register the stillbirth.
If the baby's parents are not married, it is the mother who must attend to register the stillbirth. However, if they desire to include the father's name on the registration document, then both mother and father would normally be required to attend the Registration Office at the time of registration.
When and Where do I Register a Stillbirth?
Any stillbirth which occurs in Scotland must be registered within 21 days by the Registrar. The Law requires the stillbirth to be registered at any Registration Office within Scotland.

What Documents should I take to the Registrar?
- Certificate of Stillbirth (Form 6) will be issued to the parents of a stillborn child by the registered medical practitioner or registered midwife who was present at the time of the event.
- It is helpful, but not essential, for parents to bring their own Birth Certificates and Marriage Certificate (if applicable).
- On the rare occasion where no Form 6 is available (due to a registered medical practioner or registered midwife not being present), the stillbirth still requires to be registered. Please contact the Clackmannan Registration Office for further advice.
When the Registration is complete, the Registrar will give you, free of charge:
- Certificate of Registration of Stillbirth (Form 8). This is required by the informant of the stillbirth for burial or cremation purposes.
- An extract of stillbirth, if so desired.
